Estate planning is not just for the old and the wealthy. Anyone who is single and 18 years old or older needs three (3) important estate planning documents. In this context, ‘single’ means never married, divorced, widowed, unmarried LGBTQ or in a long term relationship but not married.

My Peace of Mind package (18+) consists of an Advance Healthcare Directive, a Durable Power of Attorney and a HIPAA Authorization.

Since CA has the highest probate fee structure in the nation, it is imortant for anyone owning real estate in CA to have a Revocable Living Trust. (A Will is not enough.) This document alone could save your estate thousands of dollars. For example, an estate consisting solely of a home with fair market value of $400,000 would lose close to $25,000 to probate fees and court costs, not to mention the time (9 months to a year during  which the estate’s assets are frozen) and publicity associated with probate court.

In today’s online world, Digital Asset Protection is also necessary and a Revocable Living Trust or Will should contain a Digital Asset Executor.

An estate plan is more important than a credit card, so don’t leave home without one. If you procrastinate,  it could be too late to avoid probate. Insure yourself against the perils of probate court. That investment could be the most important one you ever make.
